James Decatur Lee has been let off with ONLY 1 YEAR PROBATION!!
He was "sentenced" on Monday December 14 by Judge Stone. You can read some of the details of what happened in the courtroom in our blog. You can also read the actual probation document in the download above.

Lee admitted to responding police officers that he "knocked in the head" and killed a litter of kittens. His mentally challenged daughter managed to save one life. This is NOT a case of a feral "nuisance" animal, or a neighbor failing to properly care for their pet. The mother cat lived on the Lee property, and was fed by Lee's family.

The following is an email sent by Judy after speaking with the State's Attorney in October 2009
I am sorry for the delay in posting. I was elated that Mrs Torres (of
the State's Attorney's office) agreed to talk to me about this case
(Lee). Then when it finally sunk in I became very disappointed and just
couldn't talk about it anymore.
I believe Mrs. Torres did her best but it just seems as if there is no
justice for animals. I tried to take notes but the following is not an
exact quote just what I remember and using my verbage.
She explained to me the trial was continued so long for multiple
reasons. Her pregnancy, a change in the public defender's office that
meant a new attorney for Lee and trying to find the witnesses to the
case.
Lee's daughter reported the crime. She is mentally impaired. One of his
sons witnessed the crime but he can't be located. They tried finding
him at 3 addresses in Gainesville.
The charge was reduced because the defense presented a Veterinarian
certified by the AVMA that testified that a blow to the head is less
painful than chemical euthanasia.
Mr Lee admitted to striking each kitten only once. Therefore the pain
and suffering was eliminated from the charges. No witnesses were able
to be served to testify otherwise.
The defense presented a C-4-3190 motion to dismiss the felony charges
and that is how Mr Lee ended up being charged with a midemeanor.
I believe Mrs. Torres said the maximum sentence was 500.00 to a 1,000.00
fine. I am not sure jail time is applicaple. I am sure the minimum is
nothing. Mr. Lee is a 69 year old man with no priors.
Mrs. Torres said she saw people from the CKG outside and planned to
approach them after the hearing but no one was there. I told her that
was because the clerk in the court room questioned Jason and Barb as to
why they were even there that day as there was no jury trial and nothing
going on. Two of my friends showed up about 10:30 or11:00. Mrs Torres
said she did NOT know why the clerk said that as a motion hearing plea
was entered that day.
Before I called Mrs Torres I called the clerk of the court twice. The
first one had no info and the 2nd one a rude snippy b---- asked me if I
knew how to get to the website I replied yes and she said she was going
to post the results in 3 minutes.
Perhaps she was the same clerk that misled Jason and Barb in the court
room?
Oh, while I had Mrs Torres on the phone I decided to inquire about the
Thayer case even though she has nothing to do with that one. My intent
was simply to learn the prodecure when one that is charged is found
incompetent to stand trial. She shared with me that the Dr. that attends
him will determine when he is competent to stand trial. At that point a
court date will be set and then the court will determine if he is
competent.
I was prepared to be angry about Mrs Torres's handling of the case. I
am not.
I am angry about the process! I know it does little good to be angry
but I am.
I don't believe for a minute that this was Mr. Lee's first attack on
animals at age 69.
Please recall I am not quoting Mrs. Torres verbatim but I am sure I have
the gist of it. I am sorry it took me so long to share the information
I have. I really have been too upset to write about it.
The sentencing date is 11-9. Please contact Judge Stone and request
that Mr.Lee be appropriately sentenced.
I did share with Mrs Torres that we would be out in force if and when
Joe Bruner goes to trial.
I have high hopes that we will pick up some new members for the group at
Dog Daze on 10-17
