Yesterday, April 22, was a good day for our cause!
Jacoby Jackson, or rather his attorney Jeffery Toney, submitted a motion to dismiss the charges. Judge Stone refused the motion, and scheduled Jackson's trial for Monday April 26.
Aeza Magadia was sentenced to jail time - 60 days, 44 suspended, 16 to serve.
This may not seem like much - 16 days in jail - but for Magadia the consequences may be enormous. Aeza Magadia is in the United States Air Force, and her commanding officer (CO) had told Judge Ward if she received any jail time she would be kicked out of the Air Force. We will have to see if that in fact happens.
Magadia's career has possibly been ruined. Some may say, "Is it really justice that a member of our armed forces, a person who protects the rest of us and our liberties, gets ruined because of a dog?" I say yes.
Just because a person has a noble, admirable, honorable profession does not make that person noble, admirable, or honorable. No one, not any of us, is above the law. The very liberties and rights that people in these professions protect apply to them too. There are plenty of doctors, military, police, firefighters, veterinarians, clergy, etc etc who have committed criminal and amoral acts.
If Rosco's death was a result of one mistake, some act of anger committed in the heat of passion, I may feel differently. But Aeza Magadia chose, day after day after day, to ignore the needs of this living, breathing being. She chose over and over to allow his suffering. Her career in the Air Force may be over, but Rosco is dead.
