Aeza Mari Magadia
Aeza Mari Magadia was sentenced to 60 days in jail (44 suspended, 16 to serve).
However, ALL jail time was WAIVED on
June 1, 2010 in a private motion hearing in Judge Ward's chambers.
She also received mental health evaluation & counseling (if needed), 1 year probation, 110 hours community service, $536 fines and court costs, and is prohibited from owning or being the caregiver of any animal during her probation period.
Judge Ward said, on April 22 during sentencing, that despite her "exceptional" work history, he wanted her to spend one day in jail for every day Rosco went without food. Judge Ward was moved by the photos of the garage where Rosco was forced to stay.
He noted "at least in jail you'll be fed everyday."
This statement was obviously for show, since Judge Ward himelf later waived the entire jail term!
Crestview Police responded to a home alarm at Magadia's house on December 17 2009. The police found her front door open, and when they went inside to investigate they found a boxer dog, Rosco, starving to death in her garage, living in filth.
According to the arrrest report, she answered a Craigslist ad for a free dog in June 2009. She described the dog as "hyper" (he's a boxer!!!) and the dog growled at her daughter. The daughter went to live with her father in November 2009.
When police entered the garage, the dog "growled initially, but when {spoken to} he came directly and was very friendly."
Magadia said she hadn't bought dog food since October. She woud give Rosco scraps from her meals, but then said she was seldom home because she often stayed at friends' houses closer to Eglin AFB.
She also stated she used to have a Yorkshire Terrier, and the Yorkie had puppies. She believes at least one puppy died because she saw a "fur ball" in the garage that later disappeared. Supposedly the Yorkie and puppies were "given away."
Rosco was seized and euthanized by Crestview Animal Control (850-682-2222).
Her neighbors had no idea she had a dog.
